Colonel Park Jeong-hoon Acquitted of Disobedience, Chae Sang-byeong Special Prosecutor Drops Appeal

Colonel Park Jeong-hoon, former head of the Marine Corps Investigation Unit and a key figure in the alleged external pressure surrounding the death of Marine Corporal Chae Sang-byeong, has been definitively acquitted of insubordination charges. The Chae Sang-byeong Special Prosecutor's Team (Special Prosecutor Lee Myung-hyun) officially announced its decision to withdraw the appeal against Colonel Park at a briefing on July 9. This final conclusion comes about 18 months after his acquittal in the first trial in January last year and is expected to be a significant turning point in the special prosecutor's investigation into the Chae Sang-byeong case.

Background of the Special Prosecutor's Decision to Withdraw the Appeal 

Special Prosecutor Lee Myung-hyun explained the decision to withdraw the appeal as a "comprehensive review of the original ruling, objective evidence, and the legal validity of the military prosecution's grounds for appeal." The special prosecutor clearly stated that Colonel Park's actions, as the head of the Marine Corps Investigation Unit, in conducting the initial investigation into Corporal Chae's death and transferring related records to the police, were "lawful acts in accordance with the law." Furthermore, it was determined that the "Ministry of National Defense's Military Prosecutor's Office's indictment of Colonel Park on charges of insubordination constituted an abuse of prosecutorial power."

The special prosecutor added that with the first-instance court already having acquitted Colonel Park, maintaining the insubordination charges in the appellate trial was deemed "not a responsible stance" for the special prosecutor's office. While the detailed reasoning could not be fully disclosed due to the ongoing special prosecutor's investigation, the special prosecutor expressed confidence that the future investigation results would be convincing to anyone. With this decision, Colonel Park's appellate trial proceedings are concluded as of today.

The Genesis and Development of Colonel Park's Insubordination Controversy 

The controversy surrounding Colonel Park Jeong-hoon's alleged insubordination originated from the death of Marine Corporal Chae Sang-byeong in July 2023. At that time, Colonel Park, as the head of the Marine Corps Investigation Unit, investigated Corporal Chae's death and attempted to transfer the investigation results, which stated that 'eight officers, including Marine Corps 1st Division Commander Lim Sung-geun, were suspected of professional negligence resulting in death,' to the police.

However, during this process, he received an order from the Ministry of National Defense to delay the transfer. Colonel Park refused this order and transferred the investigation records to the civilian police. The Ministry of National Defense deemed Colonel Park's actions as 'disobedience to a superior's lawful order' and initiated an investigation against him on charges of insubordination. Subsequently, the military prosecution indicted Colonel Park on charges of insubordination and defamation of a superior.

First-Instance Acquittal and Military Prosecution's Appeal 

On January 9, 2024, in the first-instance trial held at the Central District Military Court, the court acquitted Colonel Park. The first-instance court ruled that "Colonel Park's failure to comply with the order to delay the transfer was a lawful execution of duty and could not be considered insubordination," effectively siding with Colonel Park. The court interpreted that the Ministry of National Defense's order to delay the transfer was not conducted through proper procedures and that the Military Court Act does not restrict the military police's right to conclude initial investigations.

Despite this, the military prosecution appealed the first-instance ruling, and the case was transferred to the Seoul High Court for a second-instance trial. The military prosecution had argued that Colonel Park's actions constituted insubordination, undermining military discipline and the chain of command, and sought a guilty verdict.

Launch of the Chae Sang-byeong Special Prosecutor and Investigation Direction 

Colonel Park Jeong-hoon's case was recognized as a significant part of the 'alleged external pressure in the investigation of Corporal Chae's death' and escalated into a political controversy. Ultimately, the National Assembly passed the 'Chae Sang-byeong Special Prosecutor Act' to uncover the truth of this case, and Special Prosecutor Lee Myung-hyun was appointed, initiating a full-scale investigation. The special prosecutor's team is broadly examining not only the circumstances of Corporal Chae's death but also the alleged external pressure during the investigation process and the legality of the insubordination investigation and indictment against Colonel Park.

The special prosecutor's decision to withdraw the appeal puts an end to the insubordination controversy faced by Colonel Park and signifies that the focus of the Chae Sang-byeong special prosecutor's investigation will now shift more heavily towards uncovering the 'alleged external pressure.' The special prosecutor's determination that Colonel Park's actions were 'lawful duties' and the military prosecution's indictment was an 'abuse of prosecutorial power' will serve as a crucial benchmark for the ongoing investigation into external pressure. This decision is expected to further heighten public expectations for the truth to be revealed in the Chae Sang-byeong case.
