Puerto Rico Strengthens Workplace Rights for Women on International Women's Day

San Juan, Puerto Rico – On March 8th, International Women's Day, Puerto Rico reaffirms its commitment to women's rights in the workplace by highlighting and reinforcing the Worker Woman's Bill of Rights. This comprehensive set of rights, outlined in Law No. 9 of 2019, aims to eradicate discrimination and ensure equity for women in all employment sectors.

The Worker Woman's Bill of Rights serves as an educational tool, empowering women to understand and exercise their rights. Key provisions include:

Prohibition of Sex-Based Discrimination: Employers must maintain a safe work environment free from discrimination based on sex.
Implementation of proactive measures to prevent discriminatory practices is mandatory.
Protection Against Unjustified Dismissal: Women are protected from arbitrary termination of employment.
In cases of wrongful dismissal, employees are entitled to severance pay.
Comprehensive Maternity Leave Rights: Full salary continuation during maternity leave.
Job security and protection against suspension or discrimination due to pregnancy.
- Duration: Generally, four weeks before and four weeks after childbirth.
Flexibility to adjust pre- and postnatal leave periods.
- Government employees: Enhanced benefits, including additional leave for childcare.
Adoption: Woman who adopt pre-school children have the same right as a woman who had a birth.
Lactation and Breast Milk Expression Rights: Employers must provide a private, sanitary lactation space with necessary amenities.
Designated lactation periods during the workday.
The right to extend lactation periods up to 12 months after returning to work.
Workplace Free from Harassment and Intimidation: Protection from hostile, offensive, or intimidating behavior.
Zero tolerance for sexual harassment, including unwelcome advances.
Employers are obligated to establish internal procedures for handling harassment complaints.
Protection Against Retaliation: Safeguards for women who file complaints, testify, or participate in investigations.
Protection Against Domestic Violence: Measures to ensure women's safety in the workplace from the effects of domestic violence.

Puerto Rico's legislation reflects a broader global movement towards gender equality in the workplace.
These laws are designed to not only protect women, but to also promote healthier work environments for all.
