Seoul, South Korea – A South Korean military court has acquitted a former Marine Corps investigation unit head, Colonel Park Jung-hoon, of charges of disobeying a superior officer and defamation. Colonel Park was accused of refusing to follow an order to halt an investigation into the death of Marine Corporal Chae and of making defamatory remarks about a former defense minister.

The Central Military Court on September 9th delivered its verdict, clearing Colonel Park of all charges. The prosecution had previously sought a three-year prison sentence for Colonel Park.

The charges against Colonel Park stemmed from his handling of the investigation into the death of Marine Corporal Chae in July 2023. Park was accused of disobeying an order from the then-commander of the Marine Corps to halt the transfer of the investigation to civilian police. Additionally, he was charged with defamation for making statements that were seen as damaging the reputation of the former defense minister.

In its ruling, the court stated that while it would not make a separate judgment on whether the order to halt the investigation was legitimate, the prosecution had failed to present sufficient evidence to prove that the commander had issued a specific and individual order to Colonel Park to halt the transfer of the investigation.

Regarding the defamation charges, the court found that Colonel Park had used neutral language in his interviews and that the prosecution had not provided enough evidence to prove that he had acted with malicious intent.

In his closing statement at the trial last November, Colonel Park emphasized that unlawful orders should not be obeyed in the military.

The acquittal of Colonel Park has been seen as a victory for those who believe that he was acting in the interest of justice. However, the case has also raised questions about the military's handling of investigations and the independence of military prosecutors.
